NON-DISCRIMINATORY PROCEDURES

Cheder Lubavitch Hebrew Day Schools are committed to equal educational opportunity for all students.

It is the policy of the Schools, that no person may be denied admission to school or be denied participation in, be denied the benefits of, or be discriminated against in any curricular, extracurricular, pupil services, recreational or other program, on the basis of sex, race, national origin, immigration status, ancestry, creed, religion, pregnancy, marital or parental status, sexual orientation or physical, mental, emotional, or learning disability.

This policy also prohibits discrimination under related federal statutes, including Title VI and Title VII of the Civil Rights Act of 1964 (race, color and national origin), Title IX of the Educational Amendments of 1972 (sex), Section 504 of the Rehabilitation Act of 1973 (handicap), and Americans with Disabilities Act of 1990 and the Individuals with Disabilities Education Improvement Act of 2004 (disability).

Grading Systems

Schools shall not discriminate in the methods, practices and materials used for evaluating students on the basis of sex, race, religion, national origin, color, ancestry, creed, pregnancy, marital or parental status, sexual orientation, physical, mental, emotional or learning disability or handicap. This does not, however, prohibit the use of special testing or counseling materials or techniques to meet the individualized needs of students.

Testing Program

Schools shall not discriminate in the methods, practices and materials used for testing and evaluating students on the basis of sex, race, religion, national origin, color, ancestry, creed, pregnancy, marital or parental status, sexual orientation, physical, mental, emotional or learning disability or handicap. This policy does not prohibit the use of special testing materials or techniques to meet the individual needs of students.

Selection of Instructional Materials

Schools shall not discriminate in the selection and evaluation of instructional and library materials or media on the basis of sex, race, religion, national origin, color, ancestry, creed, pregnancy, marital or parental status, sexual orientation, physical, mental, emotional or learning disability or handicap.

Handling Public Complaints about Instruction Materials

Guidance and Counseling Program

Schools shall not discriminate in the methods, practices and materials used for testing, evaluating or counseling students on the basis of sex, race, religion, national origin, color, ancestry, creed, pregnancy, marital or parental status, sexual orientation, physical, mental, emotional or learning disability or handicap.

Extracurricular Activities

Schools shall not discriminate in admission to any program or activity, standards and rules of behavior, disciplinary actions or facilities usage on the basis of sex, race, religion, national origin, immigration status, color, ancestry, creed, pregnancy, marital or parental status, sexual orientation, physical, mental, emotional or learning disability or handicap.

School Admissions

Schools shall not discriminate in admissions to any school, class, program or activity or facilities usage on the basis of sex, race, religion, national origin, color, ancestry, creed, pregnancy, marital or parental status, sexual orientation, physical, mental, emotional or learning disability or handicap. In addition, the schools shall comply with the requirements of relevant case law, including Plyler v. Doe, 457 U.S.C. 202, 102 S. Ct. 2382 and state laws and regulations. This policy does not, however, prohibit the schools from placing a student in a school, class, program or activity based on objective standards of individual performance or need.

Student Conduct

Schools shall not discriminate in standards and rules of behavior, including student harassment, on the basis of sex, race, religion, national origin, immigration status, color, ancestry, creed, pregnancy, marital or parental status, sexual orientation, physical, mental, emotional or learning disability or handicap.

Student Discipline, including suspension and expulsion

Schools shall not discriminate in standards or rules of behavior or disciplinary action, including suspension and expulsion, on the basis of sex, race, religion, national origin, immigration status, color, ancestry, creed, pregnancy, marital or parental status, sexual orientation, physical, mental, emotional or learning disability or handicap.

Student Awards and Scholarships

Schools shall not discriminate in the acceptance and administration of gifts, bequests, scholarships and other aids, benefits or services to student from private agencies, organizations or persons on the basis of sex, race, religion, national origin, immigration status, color, ancestry, creed, pregnancy, marital or parental status, sexual orientation, physical, mental, emotional or learning disability or handicap.

Public Gifts to the Schools

Schools shall not discriminate in the acceptance and administration of gifts, bequests, scholarships and other aids, benefits or services to students from private agencies, organizations or persons on the basis of sex, race, religion, national origin, color, ancestry, creed, pregnancy, marital or parental status, sexual orientation, physical, mental, emotional or learning disability or handicap.

Sincerely Held Religious Beliefs

Schools shall provide for the reasonable accommodation of a student’s sincerely held religious beliefs with regard to examinations and other academic requirements. Requests for accommodations shall be made in writing and approved by the building principal. Accommodations may include, but not necessarily be limited to, exclusion from participation in an activity, alternative assignments, released time from school to participate in religious activities, and opportunities to make up work missed due to religious observances. Any accommodations granted under this policy shall be provided to students without prejudicial effect.

Section 504 of the Rehabilitation Act or the American with Disabilities Act

Students who have been identified as having a handicap or disability, under Section 504 of the Rehabilitation Act or the Americans with Disabilities Act, shall be provided with reasonable accommodations in educational services or programs. Students may be considered handicapped or disabled under this policy even if they are not covered under the district’s special education policies and procedures.

Facilities modifications necessary to provide a student with equal opportunities shall be made as required by law and permitted by budgetary limitations.

Discrimination in Employment Prohibited

Cheder Lubavitch shall not discriminate in any aspect of employment, including hiring, firing, pay, job assignments, promotions, layoff, training, fringe benefits, and any other term or condition of employment on the basis of race, color, religion, sex (including gender identity, sexual orientation, and pregnancy), national origin, age (40 or older), disability or genetic information. Cheder will comply with the Age Discrimination in Employment Act of 1967 in addition to the statutes enumerated above, and all other relevant federal, state and local laws and regulations.
